Frequently Asked Questions

Can the judge compel outside witnesses to testify in a debtor examination, not just the debtor?

Yes. Section 848 lets the judge order witnesses to appear and testify in these proceedings.

What standard governs how these witnesses testify?

The same manner as witnesses testify at the trial of an issue.

Who can require a witness to show up?

The text ties it to "the order of the judge," so it's the judge who directs a witness's appearance in these proceedings.
