Full Text of § 731

Text size

Executions shall be deemed process of the court, and shall be issued by the clerk, and directed to the sheriff of the county. They may be directed to different counties at the same time.

Amendment History

R.L. 1910, § 5149.

Plain-English Summary

An execution is the paperwork that turns a court judgment into actual collection action. Section 731 defines it as process of the court, meaning the clerk issues it, not a judge or the winning party, and directs it to the sheriff of the county where the debtor's property sits.

Because a debtor's assets don't always sit in one county, the section lets a judgment creditor have executions issued to several counties' sheriffs at once, instead of pursuing them one county at a time.
