Full Text of § 2016

Text size

In the absence of specific superseding legislation, the procedures for conducting pretrial conferences shall be governed by rules promulgated by the Supreme Court of Oklahoma.

Amendment History

Added by Laws 1984, SB 417, c. 164, §16, eff. 11/1/1984.

Plain-English Summary

Where FRCP 16 lays out pretrial conference procedure in detail, Oklahoma's Pleading Code takes a different approach: it defers to the Oklahoma Supreme Court's own rulemaking. Absent a more specific statute overriding the point, the mechanics of pretrial conferences, how they're scheduled, what they cover, what orders can come out of them, live in court rules rather than in Title 12 itself.

Frequently Asked Questions

Where do the actual rules for pretrial conferences in Oklahoma come from?

The Oklahoma Supreme Court's promulgated rules, not this section itself, unless a more specific statute governs the point.

Is this section Oklahoma's version of FRCP 16?

It occupies the same place in the Pleading Code's structure, but instead of setting pretrial procedure directly the way FRCP 16 does, it defers that job to the Supreme Court's rulemaking authority.

Can the Legislature override the Supreme Court's pretrial conference rules?

Yes -- the section itself yields to any specific superseding legislation the Legislature enacts on the point.
