Frequently Asked Questions

Does the District Court Mediation Act cancel out the Dispute Resolution Act?

No -- the statute says directly that it doesn't replace or supersede the Dispute Resolution Act or its implementing rules and procedures.

Can both mediation laws apply to the same case?

The text preserves the existing Dispute Resolution Act framework alongside the newer district court mediation provisions, rather than one displacing the other.

Does this protection cover the Dispute Resolution Act's implementing rules, or just the statute itself?

Both -- the section protects "any provision of the Dispute Resolution Act" as well as "the rules and procedures promulgated to implement and effectuate" it.
