Frequently Asked Questions

What is the "Nonjudicial Marketable Title Procedures Act"?

It's the short title Oklahoma law gives to Sections 1141.1 through 1141.5, a set of statutes letting a property owner try to clear a title cloud without going to court first.

Does this section create any rights or procedures itself?

No. It only supplies the name for the act; Sections 1141.2 through 1141.5 contain the actual definitions and procedures.

Why would a title-clearing statute need a nonjudicial process?

The point is to let a person clear a cloud on title by exchanging notices and a curative instrument with the other claimant, instead of automatically filing a quiet title lawsuit.
