Frequently Asked Questions

If a judgment is modified, do liens obtained under the original judgment survive?

Yes. Section 1035 preserves them, carrying them forward to the modified judgment.

Does this section apply when a judgment is vacated entirely, or only when it's modified?

The text speaks specifically to a judgment being "modified," preserving liens and securities to the judgment as modified.

Why does this rule matter to a judgment creditor?

It means pursuing a modification under this chapter won't cost a creditor the priority or security already secured under the original judgment.
