Plain-English Summary

An appeal from justice of the peace court does not go up to a court of appeal the way most Louisiana appeals do. Article 4924 routes it instead to the parish court for the parish where the justice of the peace court sits, or, in a parish with no parish court, to the district court there.

What happens next is not the record review that Article 5001 describes for parish and city court appeals. Article 4924 calls for a trial de novo, a full new trial rather than a review of what happened below, fitting for a court whose own proceedings may have generated nothing more than the informal record Article 4918 requires. And the district court's trial de novo is not held to the justice of the peace court's five-thousand-dollar jurisdictional ceiling; the appeal can proceed, and the district court can render judgment, on the same footing as any other case within its ordinary jurisdiction.

That trial de novo is also the end of the ordinary appellate line. Article 4924 allows no further appeal from the parish or district court's judgment on the trial de novo. The one avenue that remains is supervisory jurisdiction: the court of appeal that would otherwise have handled a further appeal may still review the parish or district court proceedings through its supervisory authority.

Frequently Asked Questions

Where does an appeal from justice of the peace court go?

To the parish court for that parish, or to the district court if the parish has no parish court, under Article 4924.

Is an appeal from justice of the peace court a full new trial?

Yes. Article 4924 calls it a trial de novo, meaning the parish or district court hears the case again rather than reviewing a written record from below.

Does the five-thousand-dollar jurisdictional cap follow the case up on appeal?

No. Article 4924 says the trial de novo in district court is not subject to the justice of the peace court's jurisdictional limit.

Can I appeal again after losing the trial de novo?

Not through an ordinary appeal. Article 4924 bars any further appeal, though the court of appeal that would otherwise have had appellate jurisdiction may still exercise supervisory review.
