Art. 4461.Small Tutorship Defined

Chapter 12 gives Louisiana tutorship law its own version of a streamlined track for small estates, echoing the small-succession procedure available for modest successions elsewhere in Louisiana law. A full-scale tutorship -- with its formal inventory, security requirements, and undertutor oversight -- makes sense when there is significant property at stake, but that same machinery can cost more to run than it protects when the minor's estate is modest.

Article 4461 draws the line that determines whether a tutorship qualifies for that lighter track: a small tutorship is one where the minor's property in Louisiana has a gross value of fifty thousand dollars or less. That figure has moved over time -- the dollar threshold was last adjusted by a 2013 amendment -- reflecting the legislature's periodic recalibration of what counts as a modest estate.

Meeting this definition does not change any substantive rule about how the minor's property must be used or protected; it opens the door to the specific simplifications in Articles 4462 through 4464: dispensing with a formal inventory, allowing a tutor to serve without bond, and reducing the applicable court costs.
