Amendment History

Amended by Acts 1964, No. 4, §1.

Plain-English Summary

Articles 4031 and 4032 fix venue for opening a tutorship, but a tutorship is not a one-time filing — it generates further proceedings over the life of the minority, from accounting to property sales to removal disputes. Article 4034 answers where those later proceedings belong.

Once a tutor domiciled in Louisiana has been confirmed or appointed, venue for subsequent proceedings follows that tutor's own domicile, not necessarily the parish where the case started. If the tutor later dies, venue stays with the parish of his last domicile. A court asked to handle a later proceeding that did not itself confirm or appoint the tutor may require certified copies of all or part of the original record before going forward.

A tutor who is not domiciled in Louisiana, or who has permanently left the state, does not carry venue with him in this way. Instead, later proceedings stay in the court that originally confirmed or appointed him, keeping the case anchored to a Louisiana forum even after the tutor is no longer reachable through his own domicile.

Frequently Asked Questions

Where do later tutorship proceedings get filed once a tutor is appointed?

Generally in the parish of the tutor's own domicile, under Article 4034, rather than wherever the tutorship case originally began.

What happens if the tutor later dies?

Venue for subsequent proceedings stays in the parish where the tutor was last domiciled.

What if the tutor moves to a different court's jurisdiction?

A court handling a later proceeding that did not itself confirm or appoint the tutor can require certified copies of the earlier proceedings before acting.

Does venue still follow the tutor if he is not domiciled in Louisiana?

No. For a tutor not domiciled in Louisiana, or who has permanently left the state, Article 4034 keeps later proceedings in the court that originally confirmed or appointed him.
