Text size

A writ of attachment may be obtained before the debt sued upon is due. If the debt is paid when it becomes due, the costs of the seizure shall be paid by the plaintiff.

Plain-English Summary

Attachment normally accompanies a suit on a debt already owed. Article 3543 lets it move earlier than that, allowing the writ to issue before the debt sued on has even come due. A creditor who sees clear signs of an Article 3541 ground, a debtor concealing assets or preparing to leave the state, does not have to wait for the maturity date to arrive before acting.

That early action carries a cost-shifting consequence if it turns out to have been unnecessary. If the debt is paid once it becomes due, meaning the feared default never materialized, Article 3543 puts the costs of the seizure on the plaintiff rather than the defendant.

The rule strikes a balance: it lets a creditor move preemptively against a real risk of asset flight without waiting for a technical default, while making sure that preemptive move does not come free if the debtor pays as promised once the debt matures.
