Art. 3304.Notice of Filing of Petition; Publication

Once a petition for authority and tableau of distribution are on file, Article 3304 requires the succession representative to publish notice of that filing once, in the parish where the succession proceeding is pending, in the manner Louisiana law prescribes for legal notices. Publication substitutes for individually notifying every conceivable creditor or interested party; it puts the filing on the public record where anyone paying attention can find it.

The published notice has to tell readers two things: that the petition can be homologated, meaning formally approved by the court, once seven days have passed from the date of publication, and that anyone who wants to contest it must file an opposition before that homologation happens. The seven-day figure sets a minimum, not a fixed hearing date; homologation can happen any time after that window closes, so long as no opposition beat the clock.

This published notice is a floor, not a ceiling. A creditor or other interested person who wants more assurance than a newspaper notice provides can request personal notice under Article 3305, which Article 3306 then requires the representative to mail when it has been properly requested.
