Full Text of Art. 3196

Text size

In the performance of his duties, a succession representative may exercise all procedural rights available to a litigant.

Plain-English Summary

Administering a succession often means appearing in court, not just managing property out of it. A representative may need to file suit to collect a debt owed to the succession, defend against a claim, or take part in some other proceeding touching succession property. Article 3196 confirms that when the representative does any of this, the office carries the same procedural toolkit any other litigant has.

That includes the ordinary mechanisms of Louisiana civil procedure: the exceptions, motions, discovery devices, and appellate rights available to any party litigating a claim. The representative does not need special statutory authorization for each specific procedural step; the fiduciary office itself carries standing to use the tools every litigant has.

This provision works together with Article 3211's duty to enforce claims owed to the succession, and with Article 3172's parallel grant of litigation duties to the attorney for an absent heir. Whichever provision assigns the underlying responsibility, Article 3196 supplies the procedural means to carry it out.
