Art. 2794.Confirmed Registered Support Order; Enforcement

Article 2794 does for the enforcement track what Articles 2789 and 2790 together do for the modification track, combining both effect and enforcement mechanics into a single article.

Once confirmed, the registered support order is enforced the same way as a support order the registering court issued on its own, and it is subject to the same procedures, defenses, and proceedings for enforcing or staying it that would apply to the rendering court's own order.

At a hearing to enforce a confirmed registered support order for enforcement, the obligor is limited to matters that would be available as defenses in an action to enforce the order in the rendering court. If the obligor shows that an appeal from the order is pending, will be taken, or that a stay of execution has already been granted, the court must stay enforcement, so long as the obligor furnishes the security for payment that the rendering court required. And more broadly, if the obligor shows any ground on which enforcement may properly be stayed, the court must grant an appropriate stay as long as the security required by law is furnished.

The parallel to Article 2790 is intentional: whether a support order reaches the registering court through the modification track or the enforcement track, a confirmed registration carries the same practical protections and the same limits on relitigating the underlying obligation once enforcement is sought.
