Full Text of § 9-9-16

Text size

Any judgment or any order considered a final judgment under this part may be appealed pursuant to Chapter 6 of Title 5.

Plain-English Summary

Arbitration limits how much a court can second-guess the arbitrators, but it does not eliminate appellate review of the court’s own rulings. This section confirms that any judgment entered under this part — and any order the statute treats as a final judgment, such as an order vacating an award under Code Section 9-9-13 — can be appealed.

Rather than creating a special arbitration appeal track, the section routes these appeals through Georgia’s existing appellate procedure statute. That means the ordinary rules on filing deadlines, notices of appeal, and appellate jurisdiction that apply to any other civil judgment apply here as well.

In practice, this section is what makes the earlier sections’ references to a “final judgment” meaningful. When Code Section 9-9-13 says a court’s ruling on a motion to vacate constitutes a final judgment, this section is the reason that label carries consequences — it opens the door to appellate review rather than leaving the ruling as the last word.

Frequently Asked Questions

Can a party appeal a court’s judgment confirming an arbitration award?

Yes. Any judgment or order considered a final judgment under this part may be appealed.

What procedure governs an appeal from an arbitration-related judgment?

The appeal follows Chapter 6 of Title 5, Georgia’s general appellate procedure statute.

Is an order vacating an arbitration award appealable?

Yes. Code Section 9-9-13 treats that ruling as a final judgment, which this section makes appealable.

Does this section create a special appeals process just for arbitration cases?

No. It directs these appeals into the existing appellate procedure that governs other civil appeals.

Does every order issued during an arbitration proceeding qualify for appeal under this section?

Only judgments and orders the statute treats as a final judgment; the text limits the right to appeal to those categories.
