Rule 89.Appointment of counsel for State officers and employees

Appointment of counsel for State officials and employees, under the session law the rule cites, is governed by Supreme Court Rule 68.

A pointer rather than a rule. State employees are sued for things done in the course of their work — in this court, most often social workers and other staff of the agencies that appear here — and whether the State provides them a lawyer is a question answered once, statewide, rather than court by court.

Keeping the answer in one place is the point. A rule that restated the Supreme Court's procedure here would be a second copy able to drift out of step with the first.
