Full Text of § 996.230

Text size

A new, additional, or supplemental bond is subject to all the provisions applicable to the original bond and to the provisions of this chapter, including but not limited to the provisions governing giving and objecting to a bond and liabilities and enforcement procedures.

Plain-English Summary

This section keeps a replacement or supplemental bond from becoming a loophole. Whatever provisions applied to the original bond, whether from the specific statute authorizing it or from this chapter, apply just as fully to the bond that follows it.

That includes, without limitation, this chapter's rules on how a bond is given and how it can be objected to, and the liability and enforcement provisions this batch covers in Article 14. A new surety doesn't step into a lighter set of obligations than the one it replaces.
