Text sizeJump to: (a) (b)

(a) The principal shall give a new, additional, or supplemental bond if the court or officer orders that a new, additional, or supplemental bond be given.
(b) The principal may give a new bond if a surety withdraws from or cancels the original bond or to obtain the release of sureties from liability on the original bond.

Plain-English Summary

This section opens Article 12 by drawing a line between two different reasons a new bond might appear. Subdivision (a) is mandatory: whenever the court or an officer orders a new, additional, or supplemental bond, the principal has to provide it.

Subdivision (b) is voluntary. A principal can choose to give a new bond even without an order, in either of two situations: a surety has withdrawn from or canceled the original bond under Article 13, or the principal wants the sureties on the original bond released from liability.

Either way, § 996.220 sets the form and content this new bond has to follow, and § 996.230 folds it back into the same rules, on giving, objecting to, and enforcing bonds, that governed the bond it replaces or supplements.
