Text size

Jurisdiction shall be complete after the date specified in the summons. Any party interested may, not later than the date specified in the summons, appear and contest the legality or validity of the matter sought to be determined.

Plain-English Summary

Section 862 marks the pivot point in a validation action. Jurisdiction over everyone the summons reached becomes complete once the date specified in the summons arrives. Up until that same date, any interested party can step forward, appear, and contest the legality or validity of whatever the agency is trying to validate.

After that date, the window closes. Combined with § 861.1's requirement that the deadline fall at least ten days after publication, this section turns broad publication notice into a hard, predictable cutoff -- everyone gets a chance to object, and the case then moves forward on the schedule the summons set.
