Text size

If a judgment is renewed pursuant to this article, the date of the filing of the application for renewal shall be deemed to be the date that the period for commencing an action on the renewed judgment commences to run under Section 337.5.

Plain-English Summary

Renewal doesn't just extend enforcement under this title — it also resets the clock for a separate lawsuit on the judgment. Section 337.5 sets the deadline for bringing an action on a judgment, and this section fixes the starting point for that deadline whenever the judgment has been renewed: the date the renewal application was filed.

That link matters because § 683.050 already confirms a creditor's right to sue on the judgment as an alternative, or supplement, to this title's enforcement tools. Without this section, it would be unclear whether that lawsuit's own limitations period ran from the original entry date or from a later renewal. This section answers that question directly in favor of the renewal date.

Frequently Asked Questions

From what date does the deadline for suing on a renewed judgment run?

From the date the renewal application was filed, as deemed by § 683.220.

Why does this matter if a creditor already renewed the judgment under this title?

Because § 683.050 separately allows an action on the judgment, and this section fixes when that action's own limitations period, set by § 337.5, begins to run.

Does this section change how long the § 337.5 period lasts?

No. It only fixes the starting date for that period as the renewal filing date; the length of the period itself comes from § 337.5.
