Text size

This title, except Article 2 (commencing with Section 1297.81) of Chapter 2 and Article 3 (commencing with Section 1297.90) of Chapter 2, applies only if the place of arbitration or conciliation is in the State of California.

Plain-English Summary

Having established what subject matter this title covers, this section narrows down where. Ordinarily, the title applies only if the place of arbitration or conciliation is within California -- a foreign or out-of-state arbitration falls outside its reach even if the dispute itself is otherwise international and commercial.

Two carve-outs break from that geographic limit. Article 2 and Article 3 of Chapter 2, dealing with matters that by their nature need to reach beyond a single arbitration's physical location, apply regardless of where the arbitration or conciliation is held. Everything else in the title stays tied to a California-based proceeding.
