Text size

A response to a petition under this chapter may request the court to dismiss the petition or to confirm, correct or vacate the award.

Plain-English Summary

A respondent is not limited to agreeing or disagreeing with what the petitioner asked for. The response itself can affirmatively request that the court dismiss the petition, or that it confirm, correct, or vacate the award -- whichever of those the respondent thinks is the right outcome, regardless of what the petitioner requested.

That flexibility matters in practice. A respondent facing a petition to vacate can instead ask the court to confirm the award, or to correct it rather than throw it out entirely, keeping the dispute focused on the actual disagreement rather than forcing an all-or-nothing fight over the petitioner's chosen remedy.

Frequently Asked Questions
