Rule 3.10.Application

Rule 3.10 answers a basic question before any other rule in Title 3 can matter: which cases do these rules govern? The answer is broad. The Civil Rules reach every civil case filed in a California superior court, and the rule names four categories by way of example — general civil, family, juvenile, and probate.

That breadth comes with a built-in exception. Where a more specific statute or California Rule of Court addresses the same subject, the more specific provision controls instead. Family law has its own detailed rules in a separate title, and probate has its own rules as well; where those speak directly to an issue, they take precedence over the general Civil Rules.

In practice, the Civil Rules work as the default procedural layer for the superior courts, filling gaps that the more specialized titles leave open rather than displacing them.
