Full Text of Rule 3214

Text size

Any liability of the claimant included in the judgment may be enforced by execution on the judgment or by proceedings on the bond.

Plain-English Summary

This short rule tells the prevailing side how to collect. When the interpleader judgment fixes a liability on the claimant — for instance, because the claim failed after the claimant took possession on a bond — that liability may be enforced in either of two ways: by execution on the judgment itself, or by proceeding against the bond the claimant filed.

Giving the creditor both routes ensures the bond posted to take the property truly backs the claimant’s obligation if the claim does not hold up.
