Text size
As used in this chapter ‘‘judgment’’ means a judgment or order requiring the payment of money or adjudicating the right to possession in an action of replevin, including a final or interlocutory order for the payment of costs entered in any court which is subject to these rules, either originally or upon transcript or certification from another court within the same county.
Plain-English Summary
This rule fixes the vocabulary for the chapter on moving a judgment to another county. “Judgment” is read broadly: it reaches not only an ordinary money judgment but also an order adjudicating the right to possession in a replevin action, and a final or interlocutory order for the payment of costs entered in any action.
Defining the term up front means the transfer mechanics that follow apply uniformly to every kind of enforceable judgment. A creditor does not have to guess whether an order for costs or a replevin possession order can be carried across county lines — the definition says it can.
