Full Text of Art. 74.3

Text size

Persons related by adoption seeking judicial authorization to marry in accordance with Civil Code Article 90 shall request authorization of the district court in the parish of either party's domicile.

Amendment History

Acts 1987, No. 886, §2, eff. 1/1/1988.

Plain-English Summary

Louisiana's Civil Code generally restricts marriage between people related by adoption the same way it restricts marriage between people related by blood, but it allows an exception when a court grants prior authorization. Article 74.3 fixes venue for that request: persons related by adoption who want judicial authorization to marry under Civil Code Article 90 must ask the district court in the parish where either party is domiciled.

Because either party's domicile parish works, the rule gives the couple some flexibility in choosing where to file, rather than forcing the request into a single fixed location tied to one party alone.

Frequently Asked Questions

Why would people related by adoption need court authorization to marry?

Louisiana's Civil Code places restrictions on marriage between people related by adoption similar to those for blood relatives, but it allows the marriage to proceed if a court grants authorization in advance under Civil Code Article 90.

Where do you file for this kind of judicial authorization?

In the district court of the parish where either party to the proposed marriage is domiciled, under Article 74.3.

Can either party choose the filing parish, or does it have to be a specific one?

Either party's domicile parish satisfies Article 74.3, so the couple is not limited to a single fixed location.
