Amendment History

(P.B. 1978-1997, Sec. 417.)

Plain-English Summary

A witness sometimes attends court for more than one case at once, when the cases involve the same parties and the witness appears on behalf of the same party in each. In that situation, the witness’s fees for travel and attendance are not multiplied across every case. Instead, they are taxed in one case only.

Frequently Asked Questions

Can a party collect witness fees separately for each of several related cases?

No. If the witness attends more than one case involving the same parties at the same time on behalf of the same party, travel and attendance fees are taxed for one case only.

What conditions trigger this single-fee rule?

The cases must be between the same parties, occur at the same time, and involve the witness appearing on behalf of the same party.
