Full Text of § 995.370

Text size

At the time a bond is given, the principal shall serve a copy of the bond on the beneficiary. An affidavit of service shall be given and filed with the bond.

Plain-English Summary

The beneficiary a bond protects needs to know that protection exists. Section 995.370 makes sure of that by requiring the principal to serve a copy of the bond on the beneficiary at the very time the bond is given — not at some later, more convenient point.

Proof of that service becomes part of the record too: an affidavit of service has to be given and filed along with the bond itself, using the same service rules § 995.030 sets for documents under this chapter.
