Full Text of § 995.230

Text size

The beneficiary of a bond given in an action or proceeding may in writing consent to the bond in an amount less than the amount required by statute or may waive the bond.

Plain-English Summary

The beneficiary a bond protects can decide it doesn't need the full protection the statute would otherwise require. Section 995.230 lets that beneficiary consent, in writing, to a bond in an amount less than what's statutorily required — or skip the bond altogether by waiving it.

Because the bond exists for the beneficiary's protection, it makes sense that the beneficiary can choose to accept less of it. The writing requirement keeps that choice on the record rather than leaving it to later dispute.
