Full Text of § 801.2

Text size

The action may be brought as a separate action or joined as a cause with other causes of action to determine adverse claims to and clouds upon title to real property, but the complaint shall aver the pertinent matters stated in the preceding section and shall be verified.

Plain-English Summary

This action doesn't have to stand alone. A plaintiff can bring it by itself, or join it as one cause of action alongside other claims to determine adverse claims and clouds affecting the same property.

Either way, the complaint has to do two specific things: allege the pertinent matters described in § 801.1 — identifying the assessment, bond, or certificate of sale and the basis for treating it as stale — and be verified, the same formality a petition under § 770.050 requires in the identity-of-title chapter.
