Full Text of § 706.129

Text size

The levying officer shall have copies of the forms for the "judgment debtor's claim of exemption" and "judgment debtor's financial statement" available at the levying officer's office for distribution without charge to a person who desires to make a claim of exemption under Section 706.051.

Plain-English Summary

A debtor doesn't need a lawyer, or even the internet, to get the paperwork needed to fight a wage garnishment. Section 706.129 requires the levying officer's office to keep copies of the claim of exemption and financial statement forms on hand, available to anyone who wants to make a claim, at no charge.

That access matters because employers are only required to deliver these forms to the employee once, at the time of service under § 706.104. If a debtor loses those copies, or needs a fresh set later, the levying officer's office is the backstop.
