§ 681.030.Rule Providing For Practice and Procedure; Forms

Someone has to design the paperwork that makes the Enforcement of Judgments Law usable day to day, and this section gives that job to the Judicial Council. Subdivision (a) lets the Judicial Council adopt rules governing practice and procedure under this title, filling in procedural detail the statutes themselves do not spell out. Subdivision (b) lets it prescribe the actual forms -- applications, notices, orders, writs -- and specifically allows those forms to be issued in languages other than English, with a completed non-English form carrying exactly the same legal force as its English counterpart.

Subdivision (c) imposes a more specific duty: the Judicial Council must prepare a form listing every federal and California exemption from enforcement of a money judgment against a natural person, citing the statute creating each one, and explaining how to find the current published exemption amounts under § 703.150(f). This is the origin of the standard exemption notice many judgment debtors receive -- the document that tells an individual debtor, in one place, what property state and federal law protects from a judgment creditor.

For a debtor trying to figure out what can and cannot be taken, and for a creditor trying to comply with notice obligations, this Judicial Council form is often the most immediately useful document the Enforcement of Judgments Law produces.
