§ 417.40.Proof Signed By Person Registered Under Chapter 16, Division 8, Business and Professions Code

Section 417.40 adds a documentation requirement specific to registered process servers. Any proof of service signed by a person registered under Chapter 16 (commencing with § 22350) of Division 8 of the Business and Professions Code — or by that person’s employee or independent contractor — must indicate the county in which the person is registered and the registration number assigned under Business and Professions Code § 22355.

This requirement gives the court and the parties a way to verify that the server signing the proof is in fact a properly registered process server, and where. Section 413.40 separately provides that a licensing violation by the server does not by itself invalidate otherwise-compliant service, but this section’s disclosure requirement still applies to any proof signed by a registered server. This version of the section remains in effect only until January 1, 2027, when it is scheduled to be repealed.
