Full Text of § 416.30

Text size

A summons may be served on a joint stock company or association by delivering a copy of the summons and of the complaint as provided by Section 416.10 or 416.20.

Plain-English Summary

Section 416.30 extends the corporate service rules to a different kind of entity. A summons may be served on a joint stock company or association by delivering a copy of the summons and complaint as provided by § 416.10 (service on an active corporation) or § 416.20 (service on a corporation that has forfeited its charter or dissolved).

Rather than creating a separate set of designated recipients for joint stock companies and associations, this section borrows the corporate service framework wholesale, applying whichever of the two provisions fits the entity’s current standing.

Frequently Asked Questions

How is a joint stock company served with a summons in California?

Section 416.30 allows service by delivering a copy of the summons and complaint as provided by § 416.10 or § 416.20, the same methods used for corporations.

Does it matter whether the joint stock company or association is still active?

Yes. If it is active, § 416.10’s methods apply; if it has forfeited its charter or dissolved, § 416.20’s methods apply instead.

Does § 412.30’s notice requirement apply when serving a joint stock company?

Yes. Because § 416.30 routes service through the same individuals named in § 416.10 or § 416.20, the copy served must still carry the § 412.30 notice identifying the capacity in which that person is served.
