Full Text of § 404.8

Text size

Expenses of the assigned judge, other necessary judicial officers and employees, and facilities for cases coordinated under Section 404 shall be paid or reimbursed by the state from funds appropriated to the Judicial Council.

Plain-English Summary

Running a coordinated proceeding often means bringing in an assigned judge and additional judicial officers and staff at a chosen site. § 404.8 puts that cost on the state rather than the parties or the local county, to be paid or reimbursed from funds appropriated to the Judicial Council.

That arrangement is what makes coordination workable for a smaller county, which might otherwise struggle to absorb the added judicial workload a large coordinated proceeding brings.

Frequently Asked Questions

Who pays for the extra judge and staff needed to run a coordinated proceeding?

The state, through funds appropriated to the Judicial Council, not the parties or the local county.

Does the local county share any of the cost of a coordinated proceeding?

No -- § 404.8 places that cost on the state, paid or reimbursed from funds appropriated to the Judicial Council.
