§ 403.050.Stipulation to Reclassification

Reclassification does not always require a motion. § 403.050 lets the parties stipulate to reclassify the case, so long as they do it within the time allowed to respond to the initial pleading. If the stipulation moves the case from limited to unlimited, the reclassification fee under § 403.060 must be paid when the stipulation is filed; once it is filed, and the fee paid if required, the clerk promptly reclassifies the case.

This stipulation route runs alongside the motion process in § 403.040 -- when the parties agree, neither side needs to file a motion or make the showing a contested reclassification requires.
