§ 2029.800.Application of article to pending actions

This short section fixes the article's reach in time. It applies to requests for discovery made in cases pending on or after the operative date this article's other provisions establish, meaning it doesn't matter whether the out-of-state or foreign case itself was filed before or after that date, only whether the case is still pending when the discovery request comes in.

That timing rule keeps the article from creating a gap where older pending cases would be stuck relying on whatever discovery process existed before this article took effect. As long as the underlying case is still active on or after the operative date, a party can use this article's streamlined procedures for discovery sought here.
