Title 4. Civil Discovery Act · Chapter 11. Deposition by Written Questions · Enacted 2004 · no amendments on record · Last verified July 29, 2026
Full Text of § 2028.080
Plain-English Summary
After the direct, cross, redirect, and recross questions have all been served, someone still has to hand everything to the person who runs the deposition. This section makes that the responsibility of the party who took the deposition: that party delivers to the deposition officer named in the notice a copy of the notice itself and of every question served under the sequential exchange process.
Once the deposition officer has that package in hand, the section requires prompt action. The officer proceeds without delay to ask the deponent the questions in order and to take down and record the testimony given in response, closing out the process the earlier sections set in motion.
