Text size

Except as otherwise provided by law, the right to compensation shall be deemed to have accrued at the date of filing the complaint.

Plain-English Summary

This section answers a timing question that matters for interest calculations and for other rights tied to accrual: when does the owner's right to compensation begin? The default answer is the date the plaintiff files the complaint that starts the eminent domain proceeding.

That default gives way whenever another statute says otherwise. Section 1263.015, for instance, lets the owner and public entity agree to their own payment arrangement measured from that same accrual date, and other provisions elsewhere in this title can shift the date for their own purposes. But absent one of those exceptions, filing the complaint is the moment the clock starts.

Frequently Asked Questions

When does an owner's right to compensation accrue in an eminent domain case?

On the date the complaint is filed, under § 1263.020, unless another statute provides a different date.

Is the accrual date the same as the date of valuation?

Not necessarily. The date of valuation is governed separately by Article 2 (§§ 1263.110-1263.150) and can differ from when the right to compensation accrues.

Can another law override the filing-date accrual rule?

Yes. Section 1263.020 applies except as otherwise provided by law.
