Text size

Subject to the requirements of this article, the court shall order the amount requested in the application, or such portion of that amount as the applicant is entitled to receive, to be paid to the applicant.

Plain-English Summary

This is the operative payment order behind every withdrawal application filed under § 1255.210. Once the article's requirements are met, the court orders the requested amount paid to the applicant -- or, if the applicant isn't entitled to the whole amount, whatever portion the applicant is entitled to receive.

Those requirements are what the surrounding sections spell out: the waiting period and objection procedure of § 1255.230, and any undertaking the court requires under § 1255.240 or § 1255.250 before letting disputed or excess money out the door.

Frequently Asked Questions
